Aus der Bibliothek von Prof. Dr. Albrecht Noth (1937-1999), langj�igem Professor f�r Geschichte und Kultur des Vorderen Orients in Bonn und Hamburg. Text arabisch. - Sehr guter Zustand, im Vorsatz Bibliotheksstempel. - Abu Ishaq Ibrahim Ibn Musa asch-Schatibi (1320-1388) war ein malikitischer Usul-Gelehrter aus al-Andalus, der vor allem f�r seine utilitaristische Theorie von den drei "Zwecken der Scharia" sowie die Lehre von dem sogenannten "freigestellten Nutzen" im Qiyas-Verfahren bekannt ist. Er entwickelte diese Lehren u.a. in seinem rechtstheoretischen Werk al-Muwafaqat fi usul a�-�ari'a (�Die �ereinstimmungen bei den Grundlagen der Scharia�). Asch-Schatibi nannte sein Werk al-Muwafaqat deswegen so, weil er damit einen Ausgleich der beiden Lehrrichtungen von Abu Hanifa und dem Malikiten Ibn al-Qasim bezweckte. So sollte gezeigt werden, dass hanafitische "Billigkeitserw�ng" und malikitische "Orientierung am Gemeinwohl" vom Grundsatz her �bereinstimmten. Arabic text. - Very good condition, library stamp in the endpaper. - Ibrahim bin Mosa bin Muhammad al-Shatibi al-Gharnati (1320-1388) was a Malikite Usul scholar from al-Andalus, who was known for his utilitarian theory of the three "purposes of Sharia" and the doctrine of the so-called "exempted benefits" in the Qiyas method is known. He developed these teachings, among others. in his legal theory al-Muwafaqat fi usul a�-�ari'a ("The Accordments in the Foundations of Sharia"). As-Shatibi called his work al-Muwafaqaat because he intended to balance the two disciplines of Abu Hanifa and the Malikite Ibn al-Qasim.
